Terms and Conditions

Paigent is an AI-powered platform that helps local businesses generate Instagram-ready social media posts and reels from customer Google Maps reviews. The Service allows users to fetch reviews from Google Maps, trim and enhance review text using AI, generate branded Instagram posts (PNG images) and reels (MP4 videos), and manage multiple business locations. Posts and reels are optimized for Instagram and are compatible with other social platforms including TikTok.

You must be at least 18 years of age to use the Service. By using Paigent, you represent that you are of legal age, that you own or have authority over the business(es) you are managing, and that all information you provide is accurate and complete.

To access the Service, you must create an account using a valid email address and authenticate via Google OAuth or email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@getpaigent.com if you suspect any unauthorised access to your account.

Paigent offers the following subscription plans (all in USD, billed monthly or annually):

Starter Plan ($9/month or $99/year):

• 10 Instagram posts per month
• 5 Instagram reels per month
• Review collection and AI trimming (150 reviews per sync)
• Multi-language support (voice-to-text in 50+ languages)
• 2 business locations
• Email support

Growth Plan ($19/month or $199/year):

• 50 Instagram posts per month
• 10 Instagram reels per month
• Review collection and AI trimming (300 reviews per sync)
• Multi-language support
• Photo enhancement for posts (AI-powered image quality improvement)
• 5 business locations
• Email and chat support

Pro Plan ($39/month or $399/year):

• 100 Instagram posts per month
• 40 Instagram reels per month
• Review collection and AI trimming (1000 reviews per sync)
• Multi-language support
• Photo enhancement for posts
• 15 business locations
• Priority support

All payments are processed through Paddle. Prices are in USD. Annual plans are charged upfront and offer a discount equivalent to 2 months free. Monthly subscriptions renew automatically on the same date each month unless cancelled before the renewal date.

You will receive billing emails confirming each transaction. You are responsible for keeping your payment method current.

Each plan includes monthly allowances for posts and reels. These allowances reset at the start of each calendar month (first day of the month, UTC). Unused allowances are forfeited at the end of each month and do not carry over to the next month.

Review collection has a limit per sync event, not a monthly total. You may sync reviews as many times as you wish within your limit per sync.

Photo library storage has no limit (store as many photos as you need per location).

Once you reach your monthly limit for posts or reels, you cannot generate additional content until your next billing cycle. You will be prompted to upgrade to a higher tier if you need more capacity.

Refunds are available within 14 days of purchase, provided:

1. You have not downloaded any posts, reels, or carousel packages from your account.
2. You request the refund within 14 calendar days of your initial subscription or renewal charge.

Once you download any generated content, your refund eligibility is forfeited. This is because generated content is immediately available for your commercial use (publishing to Instagram/TikTok).

To request a refund, contact hello@getpaigent.com with your order details. Refunds are processed through Paddle and may take 5-10 business days to appear in your account.

You agree not to use the Service to:

• Create posts or reels that misrepresent customer reviews or violate Instagram/TikTok Terms of Service.
• Generate content that is deceptive, fraudulent, defamatory, obscene, hateful or harmful.
• Violate any third party's intellectual property, privacy or publicity rights (including Google Maps Terms of Service and Apify's terms).
• Use reviews or customer data from businesses you do not own or have authority over.
• Reverse-engineer, copy, resell or redistribute the Service without written permission.
• Use automated tools or bots beyond normal use to generate excessive content.
• Circumvent any usage limits, access controls or security measures.
• Publish generated content in violation of Google, Instagram, or TikTok's policies.

You agree that:

• You own or have authority over the business(es) whose Google Maps reviews you are fetching.
• You will use review data only for generating social media posts for that business.
• You will comply with Google Maps Terms of Service and Apify's Terms of Service.
• Customer reviews are property of Google and the reviewers; you are granted a limited license to use them for social media promotion.

Paigent fetches reviews via Apify on your behalf. You are responsible for complying with all applicable laws and platform policies when publishing reviews to social media.

Posts and reels generated by Paigent are produced using artificial intelligence (Claude Haiku for text, Satori + Sharp for image generation, FFmpeg for video). Photo enhancement (available in Growth and Pro tiers) uses AI to improve image quality.

You are solely responsible for:

• Reviewing all content before publishing to Instagram/TikTok.
• Ensuring generated text accurately represents customer reviews.
• Ensuring you have rights to use any photos in your photo library.
• Obtaining permission from customers before publishing their reviews or photos.
• Complying with Instagram, TikTok and Google's content policies.

Paigent is not liable for any platform policy violations, takedowns, account bans or other issues arising from published content.

The Paigent platform, including all templates, code, design and technology, is owned by Paigent and protected by applicable intellectual property laws.

Content generated for you (posts, reels, text) is owned by you upon generation. You grant Paigent a non-exclusive licence to store, display and serve this content for the purpose of delivering the Service and providing backups.

You retain ownership of all photos you upload to your photo library.

Customer reviews are sourced from Google Maps and are subject to Google's Terms of Service.

Paigent integrates with:

• Apify: Google Maps review scraping and data fetching
• Anthropic (Claude Haiku): AI text trimming, caption generation
• Supabase: Database storage and authentication
• Railway: Hosting infrastructure
• Paddle: Payment processing
• Resend: Transactional email delivery

Your use of these services is subject to their respective terms and privacy policies. Paigent is not responsible for outages or failures of third-party services.

You may delete your account at any time by contacting hello@getpaigent.com. Upon account deletion:

• All your personal data (email, password hash) will be deleted within 30 days.
• All reviews, photos, and generated posts/reels will be deleted within 30 days.
• Your subscription will be immediately cancelled.
• No refund will be issued for unused time in your current billing period.

Deletion of your account is irreversible. Keep backups of any content you wish to preserve.

To the fullest extent permitted by applicable law, Paigent shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including loss of revenue, loss of data, or business interruption.

Our total liability to you shall not exceed the amount you paid to Paigent in the 30 days preceding the claim, or $100 USD, whichever is greater.

This limitation of liability applies even if we have been advised of the possibility of such damages.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Generated posts or reels will be approved by Instagram/TikTok.
• Generated content will be aesthetically pleasing or achieve any specific engagement or conversion rate.
• All Google Maps reviews will be successfully fetched.
• Photo enhancement will improve image quality in all cases.
• Multi-language voice-to-text will work accurately in all languages or accents.

Use of the Service is at your own risk.

Paigent may suspend or terminate your account if:

• You violate these Terms or applicable laws.
• You use the Service to publish false, deceptive, or harmful reviews.
• You violate Google Maps, Instagram, TikTok or any other third party's Terms of Service.
• You have not paid a due invoice for more than 30 days.
• You use the Service for fraud or illegal activity.

Suspension or termination may be immediate without notice if we believe you are engaged in illegal activity. We will attempt to notify you at your registered email address. Upon termination, you forfeit access to your account and all generated content.

These Terms are governed by the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.

If a dispute arises, you agree to first attempt to resolve it by contacting us at hello@getpaigent.com and attempting good-faith negotiation for 30 days before initiating legal proceedings.

You agree that any claim or cause of action arising out of your use of the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

We may update these Terms from time to time. Material changes will be communicated via email or by displaying a notice in the Service at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and Paigent regarding the Service and supersede all prior or contemporaneous agreements, whether written or oral.
